These Terms of Service ("Terms") govern your use of the gacp.llc website and your purchase of products from GACP LLC ("GACP," "we," "us," or "our"). By accessing our website or placing an order, you agree to these Terms.

1. Eligibility

Our products are sold on a business-to-business (B2B) wholesale basis. By creating an account, you represent that you are purchasing for business purposes and that you have the authority to bind your company to these Terms.

2. Account Registration

To access pricing, documentation, and ordering, you must apply for a trade account. We review applications and reserve the right to approve or decline any application at our discretion. You are responsible for maintaining the confidentiality of your account credentials.

3. Products and Specifications

Product descriptions, specifications, and certificates of analysis (CoAs) are provided for informational purposes. While we strive for accuracy, natural products may exhibit variation between production lots. Specifications represent typical values, not guaranteed ranges unless explicitly stated.

4. Pricing and Payment

All prices are listed in US Dollars (USD) per kilogram unless otherwise stated. Prices are subject to change without notice. Current pricing is available to approved trade account holders through our portal. Payment terms will be established upon account approval and first order.

5. Orders and Minimum Quantities

Products are available in 1 kg and 25 kg quantities. All orders are subject to product availability and our acceptance. We reserve the right to limit quantities or refuse any order.

6. Samples

Free samples are available in 50g and 100g quantities to approved trade account holders. Samples ship on the customer's UPS or FedEx account (ground service). Expedited shipping is available at additional cost.

7. Shipping and Delivery

Domestic (US): Products ship via UPS or FedEx ground on the customer's shipping account.

International: Contact us for shipping quotes, or provide your freight forwarder account details. International orders may be subject to import duties, taxes, and customs fees, which are the responsibility of the buyer.

Delivery times are estimates and not guaranteed. GACP is not liable for delays caused by carriers, customs, or events beyond our control.

8. Returns and Refunds

Due to the nature of our products, returns are accepted only for defective or non-conforming goods. Claims must be submitted within 14 days of delivery with supporting documentation. Refunds or replacements are issued at our discretion after review.

9. Quality and Compliance

All products are supplied with certificates of analysis (CoAs). It is the buyer's responsibility to verify that products meet their specific regulatory requirements and intended application. GACP products are manufactured in compliance with current Good Manufacturing Practices (cGMP) and the Federal Food, Drug, and Cosmetic Act.

10. Intellectual Property

All content on gacp.llc, including text, images, logos, and product documentation, is the property of GACP LLC. You may not reproduce, distribute, or use our content without written permission.

11. Limitation of Liability

GACP LLC provides products on an "as-is" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied. GACP shall not be liable for any indirect, incidental, or consequential damages arising from the use of our products or website.

12. Indemnification

You agree to indemnify and hold GACP LLC harmless from any claims, damages, or expenses arising from your use of our products, violation of these Terms, or infringement of any third-party rights.

13. Governing Law

These Terms are governed by the laws of the State of New York. Any disputes shall be resolved in the courts of Albany County, New York.

14. Changes to These Terms

We may update these Terms from time to time. Continued use of our website after changes are posted constitutes acceptance of the updated Terms.
